But this does not mean that people are sloppy, but, as a rule, that employees in the housing and communal services sector are dishonest. Residents' rights when rodents are found in a residential area
The Office of Rospotrebnadzor for the Ulyanovsk Region (hereinafter referred to as the Office) receives requests from residents of Ulyanovsk regarding the presence of rats in residential buildings.
Relations regarding the maintenance of common property owned by the right of common shared ownership to the owners of premises in an apartment building (hereinafter referred to as the common property) are regulated by Decree of the Government of the Russian Federation of August 13, 2006 N 491 “On approval of the Rules for the maintenance of common property in an apartment building and the rules for changing the amount of maintenance fees and repair of residential premises in the case of the provision of services and performance of work on the management, maintenance and repair of common property in an apartment building of inadequate quality and (or) with interruptions exceeding the established duration” (hereinafter referred to as the Rules).
According to the Decree of the Government of the Russian Federation dated 04/03/2013 N 290 “On the minimum list of services and work necessary to ensure proper maintenance of common property in an apartment building, and the procedure for their provision and implementation” (together with the “Rules for the provision of services and performance of work necessary to ensure proper maintenance of common property in an apartment building"), work on the maintenance of premises that are part of the common property in an apartment building includes, among other things, carrying out deratization and disinfestation of premises that are part of the common property in an apartment building.
The list of services and works included in the minimum list of services and works necessary to ensure proper maintenance of common property in an apartment building, the frequency of their provision and implementation are determined and reflected in the management agreement for the apartment building.
In accordance with Part 1 of Art. 161 of the Housing Code of the Russian Federation, as well as the provisions of the Rules, the management of an apartment building must ensure the proper maintenance of common property, while management organizations and persons providing services and performing work in the direct management of an apartment building are responsible to the owners of the premises for violation of their obligations and bear responsibility for improper maintenance of common property in accordance with the legislation of the Russian Federation and the agreement.
If rats are found in common areas of residential buildings, you must submit a written request to the organization that manages the residential building about the need to treat the premises. If the latter fails to take timely measures to comply with the requirements for the maintenance of common property in a residential building within the time limits established by law, you can contact the Department, attaching a copy of a document confirming the fact of non-fulfillment or poor quality performance

If rodents are detected in a residential apartment, the tenant can treat the apartment independently. According to Article 30 of the Housing Code of the Russian Federation No. 188-FZ of December 29, 2004, the owner of a residential premises bears the burden of maintaining this premises and, if this premises is an apartment, the common property of the owners of premises in the corresponding apartment building, is obliged to maintain this premises in proper condition.
